Uslovi korišćenja

Ovi Uslovi korišćenja se primenjuju na korišćenje studenti.rs Platforme. Molimo te da pažljivo pročitaš ove Uslove korišćenja kako bi bio/la svestan/na svojih prava i obaveza prilikom korišćenja Platforme. Možeš preuzeti i odštampati ovaj dokument.

Ovi Uslovi korišćenja, inter alia, opisuju sledeće aspekte odnosa između tebe i studenti.rs:

Pružanje Studijskih materijala (član 7) i kreiranje Profila (član 5);
Funkcionalnosti Platforme (članovi 3-6);
Procedura obaveštenja i uklanjanja (član 12);
Ograničenje odgovornosti studenti.rs (član 13).

Član 1. Definicije

U ovim Uslovima korišćenja, dole navedeni termini imaju sledeće značenje:

1.1. Informacije: sve informacije postavljene na Platformu od strane studenti.rs, uključujući – ali ne ograničavajući se na – izgled i dizajn Platforme, logotipe i zaštitne znakove, i tekstove. Informacije ne uključuju Studijske materijale.

1.2. Prava intelektualne svojine: sva prava intelektualne svojine i povezana prava kao što su autorska prava, prava žiga, patentna prava, prava na model, prava na trgovačko ime, prava baze podataka i srodna prava, kao i prava na know-how i jednokratne performanse.

1.3. Platforma: onlajn okruženje koje je razvio i nudi studenti.rs, koje omogućava Studentima iz celog sveta da razmenjuju Studijske materijale i komuniciraju jedni sa drugima. Platformi se može pristupiti putem veb sajta www.studenti.rs, uključujući sve poddomene i veb stranice, kao i mobilne verzije sajta.

1.4. Premium nalog: pretplata koja daje Studentima pristup najpopularnijim Studijskim materijalima („Premium materijal“) na Platformi i određenim funkcijama i funkcionalnostima, kao što su preuzimanje i štampanje Studijskih materijala.

1.5. Profil: individualna sekcija koju kreiraš i održavaš kada se registruješ na Platformi.

1.6. Student / ti: Korisnik Platforme.

1.7. Studijski materijal: svi studijski dokumenti, sažeci, beleške, zadaci i drugi studijski materijali koje pružaju Studenti ili koje Studenti čine dostupnim ili objavljuju koristeći Platformu, kao i komentari koje Studenti objavljuju.

1.8. studenti.rs: Giovanni Rossini Consulting, LLC

1.9. Studijske zajednice: Diskusione grupe o kursevima na Platformi gde Studenti mogu objavljivati poruke i postavljati pitanja.

1.10. Uslovi korišćenja: ovi Uslovi korišćenja studenti.rs.

Član 2. Primenjivost

2.1. Ovi Uslovi korišćenja regulišu svako korišćenje Platforme. Korišćenjem Platforme prihvataš ove Uslove korišćenja. Primena bilo kojih drugih uslova je isključena.

2.2. studenti.rs ima pravo da izmeni ili dopuni ove Uslove korišćenja. Najnoviji Uslovi korišćenja mogu se pronaći na Platformi. U slučaju izmene ili dopune koja značajno utiče na tvoja prava ili obaveze, studenti.rs će te obavestiti o ovim promenama tokom korišćenja Platforme.

2.3. U slučaju da nastaviš sa korišćenjem Platforme nakon što su ovi Uslovi korišćenja izmenjeni ili dopunjeni, time neopozivo prihvataš izmenjene ili dopunjene Uslove korišćenja. Ako se ne slažeš sa izmenjenim ili dopunjenim Uslovima korišćenja, jedina opcija koju imaš je da više ne koristiš Platformu i da obrišeš svoj Profil.

Član 3. Dostupnost

3.1. Prihvataš da Platforma sadrži samo funkcionalnosti i druge karakteristike koje se nalaze na Platformi u trenutku korišćenja („kakva jeste”). studenti.rs izričito isključuje bilo kakve eksplicitne i prećutne garancije, obaveze i jamstva bilo koje vrste, uključujući, ali ne ograničavajući se na, u vezi sa kvalitetom, bezbednošću, zakonitošću, integritetom i tačnošću Platforme, osim ako nije izričito drugačije navedeno u ovim Uslovima korišćenja.

3.2. Prihvataš da se funkcionalnosti Platforme mogu menjati.

3.3. studenti.rs ima pravo da (privremeno) stavi Platformu van funkcije i/ili da smanji njeno korišćenje bez prethodnog obaveštenja i bez obaveze da ti isplati naknadu, ako prema mišljenju studenti.rs to bude neophodno, na primer, za održavanje Platforme.

3.4. studenti.rs ne garantuje da će Platforma ili bilo koji njen deo biti dostupni u svakom trenutku i bez ikakvih prekida ili kvarova. Kvarovi na Platformi mogu nastati kao rezultat kvarova u internet ili telefonskoj vezi ili zbog virusa ili grešaka/defekata. studenti.rs nije odgovoran niti obavezan Studentima da isplati naknadu na bilo koji način za bilo kakvu štetu koja proizlazi ili nastaje usled (privremene) nedostupnosti sajta.

3.5. studenti.rs ima pravo u bilo kom trenutku da promeni, izmeni ili ugasi Platformu bez da postane odgovoran prema tebi na bilo koji način. Ako se ne slažeš sa promenama i/ili izmenama koje je napravio studenti.rs, jedini tvoj lek je da prestaneš sa korišćenjem Platforme i da obrišeš svoj Profil.

Član 4. Platforma

4.1. studenti.rs nudi Platformu gde Studenti mogu razmenjivati Studijske materijale i postavljati pitanja i komunicirati jedni sa drugima, inter alia kroz Studijske zajednice. Studenti takođe mogu dodavati imena kurseva, naslove knjiga i Studyliste (kako je definisano u nastavku). Misija studenti.rs je da osnaži Studente da se istaknu u svojim studijama pružajući najbolje alate za efikasnije učenje.

4.2. Svi Studijski materijali na Platformi imaju besplatan pregled koji obuhvata 30-50% sadržaja dokumenta. Za pristup celokupnom sadržaju i preuzimanje materijala potreban je Premium nalog.

4.3. Neki Premium materijali su dostupni samo za Studente sa Premium nalogom. Određene funkcionalnosti i funkcije Platforme, kao što su preuzimanje i štampanje Studijskih materijala, takođe zahtevaju Premium nalog.

4.4. Putem platforme Studenti dobijaju pristup milionima Studijskih materijala koje su objavili drugi Studenti. studenti.rs ne prihvata nikakvu odgovornost za Studijski materijal koji si ti ili drugi Studenti ponudili putem Platforme.

4.5. Platforma može sadržati linkove ka sajtovima trećih strana koji nisu u vlasništvu ili pod kontrolom studenti.rs. studenti.rs nema kontrolu nad i ne preuzima odgovornost za sadržaj, politike privatnosti ili prakse bilo kojih sajtova trećih strana.

Član 5. Profil

5.1. Da bi pregledao/la Premium materijale i mogao/la da koristiš određene funkcionalnosti, moraš kreirati Profil na način opisan na Platformi. Prilikom kreiranja Profila, moraš dati email adresu i lozinku koje će ti omogućiti pristup Platformi i tvom Profilu. Takođe se možeš registrovati koristeći svoj postojeći Facebook ili Google nalog.

5.2. Dozvoljeno ti je da koristiš Platformu samo ako imaš šesnaest (16) ili više godina. U slučaju da nisi navršio/la šesnaest (16) godina, prihvataš da ti je potrebna saglasnost tvog/tvojih zakonskog/ih zastupnika/ce (tvog staratelja ili (jednog od) tvojih roditelja) pre kreiranja Profila i/ili uzimanja pretplate.

5.3. Odgovoran/na si za održavanje tajnosti u vezi sa tvojim podacima za registraciju. Čim saznaš ili imaš razloga da pretpostaviš da su tvoje korisničko ime i/ili lozinka dospeli u ruke neovlašćenih osoba, moraš obavestiti studenti.rs o tome, bez prejudiciranja tvoje obaveze da sam/a preduzimaš neposredne efikasne mere kao što je promena lozinke. Prihvataš i priznaješ da si u svakom trenutku odgovoran/na i odgovoran/na za korišćenje Platforme od strane trećih lica putem tvog Profila.

5.4. Lični podaci koje pružiš tokom procesa registracije biće obrađeni u skladu sa Izjavom o politici privatnosti studenti.rs.

5.5. Priznaješ i slažeš se da kreiranjem Profila tvoje korisničko ime, fakultet i (ako je pružena) profilna slika budu vidljivi drugim Studentima ako objaviš Studijske materijale i/ili ostaviš komentare, osim ako ne izabereš da anonimno objaviš Studijske materijale i/ili učestvuješ u Studijskim zajednicama.

Član 6. Premium nalog

6.1. Studenti mogu dobiti Premium pristup ili objavljivanjem Studijskog materijala na Platformu ili uzimanjem mesečne, tromesečne ili godišnje pretplate. Cene su navedene na Platformi.

6.2. Plaćanje se vrši na način opisan na Platformi.

6.3. Objavljivanjem dokumenata možeš ostvariti dane punog Premium pristupa. Nagrade se smanjuju u svakom periodu od 30 dana: prvi dokument donosi 14 dana, drugi 7 dana, treći 3 dana. Dodatni dokumenti se i dalje objavljuju, ali bez nagrade u vidu Premium dana. Detalji su dostupni na stranici sa cenama.

6.4. studenti.rs može povremeno uvesti ili promeniti naknade za pretplatu, o čemu ćemo te unapred obavestiti. Ako tvoja trenutna pretplata još uvek traje, cena će ostati na snazi za fiksni period. Ako se ne slažeš sa promenom cene, moraš otkazati svoju pretplatu do kraja tada važećeg perioda pretplate. Ako ne otkažeš svoju pretplatu nakon što promena cene stupi na snagu, slažeš se da platiš promenjenu cenu.

6.5. studenti.rs može suspendovati ili otkazati tvoj Premium nalog ako plaćanje nije uspešno izvršeno.

6.6. Period pretplate će se automatski obnoviti za izabrani period pretplate, osim ako nisi otkazao/la svoju pretplatu na vreme (pre poslednjeg dana tvoje pretplate). U slučaju da se tvoja pretplata automatski obnovi, imaš pravo da otkažeš pretplatu u bilo kom trenutku nakon takvog obnavljanja sa rokom otkazivanja od jednog (1) meseca. U slučaju otkazivanja možeš zatražiti povraćaj dela naknade za pretplatu. To znači da plaćaš za period do stupanja otkazivanja na snagu, na osnovu standardne mesečne naknade. Ovo ne utiče na prava koja ti pripadaju po obaveznim propisima.

Član 7. Studijski materijali

7.1. Putem Platforme Studenti mogu objavljivati Studijske materijale za kurseve i fakultete koje su izabrali. Ovaj Studijski materijal mogu zatim pregledati i preuzeti drugi korisnici.

7.2. Imaš mogućnost da kreiraš takozvane Studyliste, koje sadrže Studijske materijale koje si ti izabrao/la, a koji se odnose na određeni kurs ili predmet. Ove Studyliste su vidljive drugim Studentima.

7.3. Tvoj Profil će prikazivati koji Studijski materijal nudiš na Platformi.

7.4. Za objavljivanje materijala možeš ostvariti Premium pristup u skladu sa sistemom opisanim u članu 6.3.

7.5. Način na koji se Studijski materijal može objaviti na Platformu kao i dozvoljeni formati su navedeni na Platformi.

7.6. Razumeš i prihvataš da si odgovoran/na za Studijski materijal koji objaviš na Platformi. Ti odlučuješ koji Studijski materijal objavljuješ na Platformi. studenti.rs nije odgovoran tebi ili bilo kojoj trećoj strani za bilo kakvu štetu koja proizlazi iz ili u vezi sa Studijskim materijalom koji si ti kreirao/la i podelio/la u okviru Platforme.

7.7. Razumeš i prihvataš da studenti.rs ne proverava i nije u obavezi da proverava ili pregledava Studijski materijal drugih Studenata. studenti.rs sprovodi samo automatsku proveru (kvaliteta) da verifikuje da li Studijski materijal sadrži dovoljno tekstova i/ili stranica. studenti.rs nema saznanja o i/ili uticaja na ili učešća u Studijskim materijalima koje objavljuju Studenti.

7.8. studenti.rs zadržava pravo da konvertuje Studijske materijale koje si uploadovao/la u drugi format i da automatski umetne vodeni žig i/ili reklame u Studijske materijale.

7.9. Ako ti ili posetilac Platforme smatraš da je određeni Studijski materijal nezakonit, možeš to prijaviti studenti.rs. studenti.rs zadržava pravo da ukloni Studijske materijale u skladu sa članom 12.

7.10. studenti.rs zadržava pravo da odbije ili ukloni Studijski materijal sa Platforme (na primer, ako je dotični Studijski materijal prijavljen i/ili dobije negativne ocene) i/ili da premesti Studijski materijal, bez prihvatanja bilo kakve odgovornosti za njegov sadržaj, bez odgovornosti za bilo kakvu štetu i bez obaveze da isplati bilo kakvu naknadu.

7.11. Možeš obrisati svoje Studijske materijale putem naše stranice za podršku.

Član 8. Tvoje obaveze i korišćenje Platforme

8.1. Koristićeš Studijske materijale ponuđene na Platformi samo kao pomoć za učenje i u skladu sa akademskim integritetom.

8.2. Ne smeš preprodavati, distribuirati ili na bilo koji drugi način ostvarivati profit od Platforme.

8.3. Ne smeš objavljivati cele (e-)knjige na Platformu.

8.4. Nije ti dozvoljeno da koristiš Platformu za svrhe navedene u nastavku, da činiš dostupnim Studijski materijal:

koje nije povezano sa svrhom studenti.rs;
kao svoj rad ako to nije tvoj rad, jer je ovo kršenje autorskog prava. Ovo je takođe plagijat i predstavlja akademski prekršaj na svim akademskim institucijama;
koje je, prema nahođenju studenti.rs, diskriminišuće ili se na drugi način smatra povređujućim, uvredljivim ili neprikladnim;
u kome se objavljuju lični podaci drugih, osim u skladu sa važećim zakonom;
koje sadrži scrapere, spidere, viruse, trojanske konje, crve, botove ili drugi softver koji može oštetiti ili obrisati Platformu ili je učiniti neupotrebljivom ili nedostupnom, ili koji je namenjen zaobilaženju tehničkih mera zaštite studenti.rs, Sajta i/ili računarskih sistema studenti.rs;
koje krši prava studenti.rs i/ili trećih lica, uključujući ali ne ograničavajući se na prava intelektualne svojine ili prava koja se tiču zaštite privatnosti;
koje predstavlja ili prenosi neželjeni ili nenaručeni materijal ili sadržaj (spam);
koje je suprotno ovim Uslovima korišćenja ili bilo kom važećem zakonu ili propisu, koje je na bilo koji drugi način nezakonito ili koje bi moglo naneti štetu interesima i reputaciji studenti.rs.

8.5. studenti.rs neće biti u obavezi da izvrši bilo kakvo plaćanje, oporezivanje, namet ili odbitak bilo koje vrste bilo kome kao rezultat Studijskih materijala koje si objavio/la, uključujući licima ili stranama čiji rad, model, brend ili performansa je uključena u Studijske materijale, uključujući organizacijama za kolektivno ostvarivanje prava.

8.6. studenti.rs zadržava pravo, bez prethodnog obaveštenja, da skrati, izmeni, odbije i/ili ukloni Studijske materijale i/ili komentare od tebe ako je to neophodno prema mišljenju studenti.rs, bez da to rezultira bilo kakvom odgovornošću.

8.7. studenti.rs ima pravo da (privremeno) ograniči ili suspenduje tvoje aktivnosti u vezi sa Platformom i/ili da obriše tvoj Profil u slučaju da prekršiš ove Uslove korišćenja.

Član 9. Prava intelektualne svojine

9.1. Prava intelektualne svojine u vezi sa Platformom, uključujući prava intelektualne svojine u vezi sa Informacijama, pripadaju studenti.rs ili njegovim davaocima licenci. Ništa u Uslovima korišćenja nema za cilj da podrazumeva bilo kakav prenos Prava intelektualne svojine na tebe.

9.2. Pod uslovima navedenim u ovim Uslovima korišćenja, studenti.rs ti daje ograničeno, lično, opozivo, neekskluzivno, nesublicencirano i neprenosivo pravo pristupa i korišćenja Platforme, uključujući Informacije, u meri u kojoj je to neophodno za korišćenje Platforme.

9.3. Kolekcija Studijskih materijala i Informacija, koja je prikupljena od strane studenti.rs i prikazana na Platformi je pravno zaštićena baza podataka. studenti.rs je proizvođač baze podataka i stoga ima isključivo pravo da odobri dozvolu za i) ekstrakciju ili ponovnu upotrebu celokupnog ili značajnog dela, sa kvantitativnog i/ili kvalitativnog stanovišta, sadržaja baze podataka i ii) ponavljanu i sistematsku ekstrakciju ili ponovnu upotrebu neznačajnih delova, sa kvantitativnog i/ili kvalitativnog stanovišta, sadržaja baze podataka, u meri u kojoj je to u suprotnosti sa normalnim radom baze podataka ili nanosi neopravdanu štetu legitimnim interesima studenti.rs. Možeš zahtevati ili ponovo koristiti podatke iz baze podataka samo ako je i u meri u kojoj je to dozvoljeno ovim Uslovima korišćenja.

9.4. Zadržavaš sva Prava intelektualne svojine na svoj Studijski materijal. Čineći dostupnim Studijski materijal putem Platforme automatski daješ studenti.rs besplatnu, neopterećenu, globalnu, neekskluzivnu, trajnu i neopozivu licencu, uključujući pravo na (pod)licenciranje, da koristi ovaj Studijski materijal u vezi sa Platformom i za marketinške i/ili promotivne svrhe Platforme. Ova licenca ne prestaje kada ukloniš svoj Profil i/ili prestaneš sa korišćenjem Platforme.

9.5. Ovim se odričeš svojih moralnih prava na Studijski materijal, u meri u kojoj je to primenljivo i u meri u kojoj je to moguće.

9.6. Garantuješ da nema (Prava intelektualne svojine) trećih lica koja te sprečavaju da učiniš Studijski materijal dostupnim putem Platforme i/ili da pružiš licencu navedenu u članu 9.4.

9.7. Suzdržaćeš se od bilo kakvog čina koji krši Prava intelektualne svojine studenti.rs, uključujući – ali ne ograničavajući se na – registraciju domenskih imena, zaštitnih znakova ili Google Adwords koji su identični ili slični bilo kom objektu na koji studenti.rs ima Prava intelektualne svojine, kao i reprodukciju, modifikaciju, obrnuti inženjering ili objavljivanje Platforme, uključujući Informacije, za druge svrhe osim onih navedenih u Uslovima korišćenja.

Član 10. Obeštećenja i garancije

10.1. Garantuješ da nećeš koristiti Platformu na način koji (i) krši prava studenti.rs ili trećih lica, uključujući – ali ne ograničavajući se na – Prava intelektualne svojine ili prava u vezi sa zaštitom privatnosti, (ii) je suprotan bilo kom važećem zakonu ili propisu, ili (iii) je suprotan bilo kojoj odredbi u ovim Uslovima korišćenja.

10.2. Odgovoran/na si i obeštećuješ studenti.rs od svih potraživanja trećih lica zasnovanih na tvrdnji da Studijski materijal krši bilo koja Prava intelektualne svojine ili druga prava trećih lica ili je na drugi način nezakonit prema trećim licima, kao i od svih potraživanja koja proizlaze iz tvojih radnji koje krše ove Uslove korišćenja. Svi troškovi i šteta koju pretrpi studenti.rs koji su na bilo koji način povezani sa gore navedenim potraživanjima biće nadoknađeni od tebe.

10.3. studenti.rs ne garantuje (i) prikladnost Platforme za određenu svrhu ili da će Platforma ispuniti bilo koje tvoje zahteve, (ii) da će Platforma biti dostupna tebi u svakom trenutku i bez prekida ili smetnji; (iii) da su Studijski materijal i/ili Informacije na Platformi tačni, ažurirani ili potpuni.

Član 11. Preuzimanje i deljenje Studijskog materijala

11.1. Studenti sa Profilom i Premium nalogom imaju mogućnost da preuzimaju Studijske materijale sa Platforme samo za ličnu upotrebu. Tvoj Profil će pokazati koji Studijski materijal si preuzeo/la.

11.2. Preuzimanje Studijskog materijala je dozvoljeno u okviru mesečnog limita preuzimanja koji zavisi od tipa pretplate. Svako preuzimanje se računa u mesečni limit. Broj preuzimanja po mesecu zavisi od tipa pretplate i naveden je na stranici sa cenama.

11.3. Prihvataš i priznaješ da je deljenje Studijskih materijala dozvoljeno samo korišćenjem linka ka Platformi. Nije ti dozvoljeno da deliš Studijske materijale koje si preuzeo/la drugim sredstvima osim linka.

Član 12. Obaveštenje o navodnom nezakonitom materijalu i ponavljani prekršioci

12.1. Ako veruješ da bilo koji Studijski materijal na Platformi krši tvoja prava ili prava trećih lica ili je nezakonit, možeš nas obavestiti popunjavanjem kontakt formulara ili slanjem obaveštenja na [email protected] (ili [email protected]). Razmotrićemo obaveštenje i, ako je moguće i potrebno, preduzeti mere navedene u ovom članu.

12.2. U obaveštenju moraš navesti: (i) tvoje ime i kontakt podatke; (ii) identifikaciju materijala; (iii) URL ili drugu informaciju koja nam omogućava da pronađemo materijal na Platformi; (iv) izjavu da si vlasnik prava ili da si ovlašćen/a da postupaš u ime vlasnika prava; (v) izjavu o nezakonitosti ili kršenju prava; i (vi) potpis.

12.3. studenti.rs ima politiku prema ponavljanim prekršiocima. To znači da će studenti.rs, u odgovarajućim okolnostima, ukloniti pristup korisnika koji višestruko krši ove Uslove korišćenja.

12.4. studenti.rs sprovodi proceduru obaveštenja i uklanjanja. Ako dobijemo obaveštenje koje ispunjava zahteve iz ovog člana, promptno ćemo ukloniti ili onemogućiti pristup dotičnom materijalu.

12.5. studenti.rs će obavestiti korisnika koji je objavio sporni materijal o obaveštenju i uklanjanju. Korisnik ima pravo da podnese protiv-obaveštenje ako veruje da je materijal uklonjen greškom.

12.6. studenti.rs ne prihvata odgovornost za bilo kakvu štetu koja nastane iz primene procedure obaveštenja i uklanjanja.

Član 13. Ograničenje odgovornosti

13.1. studenti.rs će biti odgovoran samo za direktnu štetu koja je rezultat namerne povrede ili grube nepažnje studenti.rs. studenti.rs neće nikada biti odgovoran za indirektnu štetu, uključujući – ali ne ograničavajući se na – posledičnu štetu, izgubljenu dobit, izgubljene uštede, gubitak podataka ili štetu usled poslovnog prekida.

13.2. Odgovornost studenti.rs za direktnu štetu je ograničena na maksimalni iznos pokriven osiguranjem studenti.rs za takvo potraživanje. Ako osiguranje ne pokrije štetu ili osiguravač ne izvrši plaćanje, odgovornost studenti.rs je ograničena na iznos koji si platio/la studenti.rs tokom perioda od šest (6) meseci pre nastanka štete.

13.3. Ograničenja odgovornosti u ovim Uslovima korišćenja ne primenjuju se u slučaju namere ili grube nepažnje od strane studenti.rs ili u slučaju štete nastale usled smrti ili telesne povrede.

13.4. Sve radnje prema studenti.rs zastarevaju u roku od jedne (1) godine od dana kada su okolnosti na kojima se radnja zasniva postale poznate ili razumno poznate oštećenoj strani.

Član 14. Viša sila

14.1. U slučaju više sile, neispunjavanje ugovora između tebe i studenti.rs ne može se smatrati pripisivim propustom i studenti.rs je oslobođen svih ugovornih obaveza i odgovornosti.

14.2. Viša sila uključuje, ali nije ograničena na, bolest zaposlenih i/ili odsustvo osoblja ključnog za pružanje Platforme, prekide u snabdevanju električnom energijom, požar, prirodne katastrofe, štrajkove, poplave, propust trećih lica angažovanih od strane studenti.rs, smetnje u internet vezi, hardverske kvarove, smetnje u (telekomunikacionim) mrežama i druge nepredviđene okolnosti.

Član 15. Prestanak korišćenja

15.1. Imaš pravo da prestaneš da koristiš Platformu i da ukineš svoj Profil.

16.1. Ovi Uslovi korišćenja i korišćenje Platforme podležu pravu države Delaware, SAD, osim ako obavezni propisi o zaštiti potrošača ne nalažu drugačije.

16.2. Svi sporovi koji proizlaze iz ili u vezi sa ovim Uslovima korišćenja biće rešavani pred nadležnim državnim ili saveznim sudovima u državi Delaware, SAD, osim ako obavezni zakon ne nalaže drugačije.

16.3. Ako je bilo koja odredba ovih Uslova korišćenja ništava ili nevažeća, ostale odredbe ostaju na snazi. Ništava ili nevažeća odredba biće zamenjena odredbom koja najviše odgovara nameri originalne odredbe.

These Terms of Service apply to the use of the studenti.rs Platform. Please read these Terms of Use carefully to ensure that you are aware of your rights and obligations when using the Platform. You can download and print this document.

These Terms of Use, inter alia, describe the following aspects of the relationship between you and studenti.rs:

The provision of Study Material (article 7) and creating a Profile (article 5);
The functionalities of the Platform (articles 3-6);
The notice and takedown procedure (article 12);
The limitation of liability of studenti.rs (article 13).

Article 1. Definitions

In these Terms of Use, the terms listed below have the following meaning:

1.1. Information: all information placed on the Platform by studenti.rs itself, including – but not limited to – the layout and look and feel of the Platform, the logos and trademarks, and texts. The Information does not include Study Materials.

1.2. Intellectual Property Rights: any and all intellectual property rights and associated rights such as copyrights, trademark rights, patent rights, model rights, trade name rights, database rights, and neighboring rights, as well as the rights to know-how and one-line performances.

1.3. Platform: the online environment developed and offered by studenti.rs, which enables Students from around the world to exchange Study Materials and interact with each other. The Platform can be accessed through the website www.studenti.rs, including all underlying domains and web pages, as well as mobile versions of the website.

1.4. Premium Account: a subscription that gives Students access to the most popular Study Materials (“Premium Material“) on the Platform and certain features and functionalities, such as downloading and printing Study Materials.

1.5. Profile: an individual section created and maintained by you when you register for the Platform.

1.6. Student / you: a User of the Platform.

1.7. Study Material: all the study documents, summaries, notes, assignments and other study materials provided by Students or that Students make accessible or publish using the Platform, as well as comments posted by Students.

1.9. Study Communities: Course discussion groups on the Platforms where Students can post messages and ask questions.

1.10. Terms of Use: these Terms of Use of studenti.rs.

Article 2. Applicability

2.1. These Terms of Use govern every use of the Platform. By using the Platform, you accept these Terms of Use. The applicability of any other terms and conditions is excluded.

2.2. studenti.rs is entitled to amend or supplement these Terms of Use. The most up-to-date Terms of Use can be found on the Platform. In the event of an amendment or supplementation that significantly affects your rights or obligations, studenti.rs will bring these changes to your attention during the use of the Platform.

2.3. In the event that you continue the use of the Platform after these Terms of Use have been amended or supplemented, you thereby irrevocably accept the amended or supplemented Terms of Use. If you do not agree with the amended or supplemented Terms of Use, the only option you have is to no longer use the Platform and to terminate your Profile.

Article 3. Availability

3.1. You accept that the Platform contains only the functionalities and other characteristics as found on the Platform at the time of use (“as is basis”). studenti.rs expressly excludes any explicit and tacit guarantees, undertakings and warranties of any nature whatsoever including, but not limited to, with regard to the quality, safety, lawfulness, integrity and accuracy of the Platform, unless explicitly stated otherwise in these Terms of Use.

3.2. You accept that the functionalities of the Platform may change.

3.3. studenti.rs is entitled to put the Platform (temporarily) out of service and/or to reduce the use of it without any prior notification and without being obliged to pay compensation to you, if in the opinion of studenti.rs this is necessary, for instance, for maintenance of the Platform.

3.4. studenti.rs does not guarantee that the Platform or any part thereof will be accessible at all times and without any interruptions or failures. Failures in the Platform can occur as a result of failures in the internet or phone connection or by viruses or faults/defects. studenti.rs is not liable or obliged to Students to pay compensation in any way whatsoever for any damage resulting or arising from the website being (temporarily) unavailable.

3.5. studenti.rs is at any time entitled to change, alter or shut down the Platform without becoming liable to you in any way. If you do not agree with the changes and/or amendments made by studenti.rs, your only remedy is to cease the use of the Platform and to delete your Profile.

Article 4. The Platform

4.1. studenti.rs offers a Platform where Students can exchange Study Materials and ask questions and communicate with each other, inter alia through Study Communities. Student can also add course names, book titles and Studylists (as defined below). studenti.rs’s mission is to empower Students to excel at their studies by providing the best tools to study more efficiently.

4.2. All Study Materials on the Platform include a free preview covering 30-50% of the document content. To access full content and download materials, a Premium account is required.

4.3. Some Premium Materials are only available for Students with a Premium Account. Certain functionalities and features of the Platform, such as downloading and printing Study Materials, also require a Premium Account.

4.4. Through the platform Students gain access to millions of Study Materials posted by other Students. studenti.rs accepts no liability whatsoever for the Study Material offered by you or other Students by means of the Platform.

4.5. The Platform may contain links to third party websites that are not owned or controlled by studenti.rs. studenti.rs has no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third party websites.

Article 5. Profile

5.1. In order to view Premium Materials and to be able to use certain functionalities, you have to create a Profile in the way described on the Platform. When creating a Profile, you must give an email address and password which will allow you to access the Platform and your Profile. You can also register using your existing Facebook or Google account.

5.2. You are only allowed to use the Platform when aged sixteen (16) or older. In the event that you have not yet reached the age of sixteen (16), you accept that you need the consent of your legal representative(s) (your guardian or (one of) your parents) before creating a Profile and/or taking out a subscription.

5.3. You are responsible for maintaining secrecy with regard to your registration details. As soon as you know or have reason to assume that your username and/or password has come into the hands of unauthorized persons, you must inform studenti.rs of this, without prejudice to your own obligation to take immediate effective measures yourself such as changing your password. You accept and acknowledge that you are at all times responsible and liable for the use of the Platform by third parties via your Profile.

5.4. The personal data you provide during the registration process will be processed in accordance with studenti.rs’s Privacy Policy Statement.

5.5. You acknowledge and agree that by creating a Profile your user name, university and (if provided) profile picture are visible to other Students if you post Study Materials and/or place comments, unless you choose to post Study Materials and or partake in Study Communities anonymously.

Article 6. Premium Account

6.1. Students can obtain Premium access by either posting Study Material to the Platform or by taking out a monthly, quarterly or yearly subscription. The prices are communicated on the Platform.

6.2. Payment is due in the manner described on the Platform.

6.3. By uploading documents, you can receive days of full Premium access. The allocation diminishes within each 30-day period: the first document grants 14 days, the second grants 7 days, the third grants 3 days. Additional documents are still published but without Premium day rewards. Details are available on the pricing page.

6.4. studenti.rs may introduce or change the subscription fees from time to time, for which we will give you advance notice. If your current subscription is still running, the price will remain in force for the fixed term. If you do not agree with the price change, you must cancel your subscription by the end of the then-current subscription term. If you do not cancel your subscription after the price change goes into effect, you agree to pay the changed price.

6.5. studenti.rs may suspend or cancel your Premium Account if a payment is not successfully settled.

6.6. The subscription period will be renewed automatically for the selected subscription period, unless you have cancelled your subscription on time (before the last day of your subscription). In case your subscription is automatically renewed, you have the right to cancel the subscription at any time after such renewal with a cancellation term of one (1) month. In case of cancellation you may request reimbursement of part of the subscription fee. This means that you pay for the period until the cancellation enters into force, based on the standard monthly fee.

Article 7. Study Materials

7.1. By means of the Platform Students can post Study Material for the courses and university selected by them. This Study Material can subsequently be viewed and downloaded by other users.

7.2. You have the possibility to create so-called Studylists, containing Study Materials selected by you relating to a certain course or subject. These Studylists are visible to other Students.

7.3. Your Profile will state what Study Material you offer on the Platform.

7.4. For uploading materials, you can receive Premium access according to the system described in Article 6.3.

7.5. The manner in which the Study Material can be posted to the Platform as well as the permitted formats are stated on the Platform.

7.6. You understand and accept that you are responsible and accountable for the Study Material you post on the Platform. You decide what Study Material you post on the Platform. studenti.rs is not liable to you or any third party for any damages arising out of or in relation to the Study Material created and shared by you within the Platform.

7.7. You understand and accept that studenti.rs does not, and is under no obligation to, check or (re)view Study Material of other Students. studenti.rs only conducts an automated (quality) check to verify whether the Study Material contains sufficient texts and/or pages. studenti.rs has no knowledge of and/or influence on or involvement with the Study Materials posted by Students.

7.8. studenti.rs reserves the right to convert the Study Materials you uploaded to another format and to automatically insert a watermark and/or advertisements in the Study materials.

7.9. If you or a visitor of the Platform are of the opinion that certain Study Material is unlawful, you can report this to studenti.rs. studenti.rs retains the right to remove Study Materials in accordance with article 12.

7.10. studenti.rs retains the right to decline or remove Study Material from the Platform (for example, if the Study Material in question is reported and/or gets negative ratings) and/or to relocate the Study Material, without accepting any responsibility or liability for its contents, without being held liable for any damage and without being obliged to pay any compensation.

7.11. You can delete your Study Materials via our Support Page.

Article 8. Your obligations and use of the Platform

8.1. You will only use the Study Materials offered on the Platform as a study aid and in accordance with academic integrity.

8.2. You may not resell, distribute, or in any other way make profit of the Platform.

8.3. You shall not post entire (e-)books to the Platform.

8.4. You are not permitted to use the Platform for a purpose as listed below, make Study Material available:

which is unrelated to the purpose of studenti.rs;
as your own work if it is not, as this is in breach of copyright. This is also plagiarism and constitutes academic misconduct at all academic institutions;
which, at the discretion of studenti.rs, is discriminating or is otherwise deemed hurtful, offensive or inappropriate;
in which personal data of others is made available, other than in compliance with applicable law;
which contains scrapers, spiders, viruses, Trojan horses, worms, bots or other software which can damage or delete the Platform or make it unusable or inaccessible, or which or which is intended to circumvent technical protection measures of studenti.rs, the Website and/or the computer systems of studenti.rs;
which infringes the rights of studenti.rs and/or third parties, including but not limited to intellectual property rights or rights concerning the protection of privacy;
which qualifies as or transmits unwanted or unsolicited material or content (spam);
is contrary to these Terms of Use or any applicable laws or regulations, is in any other manner unlawful or which could prejudice the interests and reputation of studenti.rs.

8.5. studenti.rs will not be obliged to perform any payment, taxation, levy or deduction of any nature whatsoever to anyone as a result of Study Materials posted by you, including to persons or parties whose work, model, brand or performance is included in the Study Materials, including to collective rights organizations.

8.6. studenti.rs reserves the right, without prior notice, to abridge, alter, refuse and/or remove Study Materials and/or comments by you if this is necessary in studenti.rs’s opinion, without this resulting in any liability.

8.7. studenti.rs is entitled to (temporarily) restrict or suspend your activities in connection with the Platform and/or to delete your Profile in the event you violate these Terms of Use.

Article 9. Intellectual property rights

9.1. The Intellectual Property Rights in relation to the Platform, including the intellectual property rights with respect to the Information, are held by studenti.rs or its licensors. Nothing in the Terms of Use is intended to entail any transfer of Intellectual Property Rights to you.

9.2. Under the conditions set out in these Terms of Use, studenti.rs grants you a limited, personal, revocable, non-exclusive, non-sub licensable and non-transferable right to access and use the Platform, including the Information, insofar as is necessary for the use of the Platform.

9.3. The collection of Study Materials and Information, that is collected by studenti.rs and displayed on the Platform is a legally protected database. studenti.rs is the producer of the database and therefore has the exclusive right to grant permission for i) the extraction or re-utilization of the entirety or a substantial part, from a quantitative and/or qualitative point of view, of the contents of the database and ii) the repeated and systematic extraction or re-utilization of non-substantial parts, from a quantitative and/or qualitative point of view, of the contents of the database, in so far as this is in conflict with the normal operation of the database or causes unjustified damage to studenti.rs’s lawful interests. You may only request or reuse data from the database if and in so far as this is permitted under these Terms and Conditions.

9.4. You retain all Intellectual Property Rights to your Study Material. By making available Study Material via the Platform you automatically grant studenti.rs a free, unencumbered, global, non-exclusive, perpetual and irrevocable license, including the right to (sub)license, to use this Study Material in connection with the Platform and for the Platform’s marketing and/or promotional purposes. This license does not end when you remove your Profile and/or you discontinue the use of the Platform.

9.5. You hereby waive your moral rights to Study Material, in so far as applicable and in so far as possible.

9.6. You warrant that there are no (Intellectual Property) Rights of third parties which preclude you from making the Study Material available through the Platform and/or providing the license as mentioned in Article 9.4.

9.7. You shall refrain from any act that infringes the Intellectual Property Rights of studenti.rs, including – but not limited to – the registration of domain names, trademarks or Google Adwords that are identical or similar to any object to which studenti.rs holds Intellectual Property Rights, as well as the reproduction, modification, reverse engineering or publishing of the Platform, including the Information, for other purposes than those listed in the Terms of Use.

Article 10. Indemnities and warranties

10.1. You guarantee that you will not use the Platform in a way that (i) infringes the rights of studenti.rs or third parties, including – but not limited to – Intellectual Property Rights or rights in relation to the protection of privacy, (ii) is contrary to any current legislation or regulations, or (iii) is contrary to any provision in these Terms of Use.

10.2. You are liable and indemnify studenti.rs against any and all claims of third parties based on the allegation that the Study Material infringes any Intellectual Property Right or other right of third parties or is otherwise unlawful against third parties as well as against all claims resulting from your actions in violation with these Terms of Use. All costs incurred and damages suffered by studenti.rs which are in any way related to the abovementioned claims will be remunerated by you.

10.3. studenti.rs does not guarantee (i) the Platform’s fitness for a particular purpose or that the Platform shall meet any of your requirements, (ii) that the Platform shall be available to you at all times and without interruptions or disturbances; (iii) that the Study Material and/or Information on the Platform are accurate, up to date or complete.

Article 11. Downloading and sharing Study Material

11.1. Students with a Profile and a Premium Account have the ability to download Study Materials from the Platform for personal use only. Your Profile will show what Study Material you have downloaded.

11.2. Downloading Study Materials is permitted within the monthly download limit included with your subscription. Each download counts toward your monthly limit. The number of downloads per month depends on your subscription type and is listed on the pricing page.

11.3. You accept and acknowledge that sharing Study Materials is only permitted using a link to the Platform. You are not permitted to share Study Materials that you have downloaded by other means that a link.

Article 12. Notice of alleged unlawful material & repeat infringers

12.1. studenti.rs respects the (Intellectual Property) Rights of others and takes the protection of (Intellectual Property) Rights seriously. Although studenti.rs is not liable for any damages in connection with the (illegal) use of the Platform by Students, studenti.rs will, under the conditions as set out in this Article, remove Study Material(s) that is (are) infringing and/or unlawful and stop manifestly unlawful behavior after receiving a notification that is sufficiently precise and adequately substantiated.

12.2. If you claim that certain Study Material infringe on your (Intellectual Property) Rights, you can report this alleged infringement to studenti.rs by filling in the contact form or by notifying us via [email protected] (or [email protected]). We will examine the notice and, if possible and necessary, take the measures stated in this article.

12.3. studenti.rs reserves the right to not grant a request to remove Study Materials or to stop an activity in case it has reasonable grounds to doubt the accuracy of the notification or in case a balancing of interest requires this. In such a situation, studenti.rs can require a court order from a competent court, to demonstrate that the material or the activity is manifestly unlawful.

12.4. Prior to removal of any alleged unlawful Study Material(s), studenti.rs may request and the notifying party shall provide, additional information substantiating that the notifying party is indeed the rightsholder, and studenti.rs may request and the notifying party shall provide, a signed copy of an indemnification declaration for studenti.rs.

12.5. studenti.rs will not be a party in a dispute between the person making the report and any third party arising out of or in connection with a notification.

12.6. studenti.rs has a policy of terminating accounts of Students who repeatedly and intentionally infringe the Intellectual Property Rights of others.

12.7. The notifying party indemnifies studenti.rs against all claims of third parties in relation to the blocking or removal of Study Materials or the stopping of activities as a result of the notification. The indemnification includes all damages and costs studenti.rs suffers, could suffer or which studenti.rs must incur in relation to such a claim, including but not limited to the compensation of legal assistance.

12.8. studenti.rs respects and protects the privacy of those who provide notifications. All personal data that it receives as part of a notification will only be used to process the notice.

12.9. studenti.rs reserves the right to forward the notice to the Student responsible for the Study Material to which the notice refers.

Article 13. Liability

13.1. studenti.rs accepts no liability whatsoever for damages resulting from the provision of the Platform, including damage resulting from or in connection with the use of the Platform or from wrongful acts or otherwise, in so far as this is permitted pursuant to mandatory law.

13.2. In the event that studenti.rs – despite the above – is liable, this liability is limited to direct damages the Student suffers as a result of a shortcoming or wrongful act that can be attributed to studenti.rs. Direct damage only includes material damage to goods, reasonable costs incurred to prevent or limit direct damage and reasonable costs incurred to determine the cause of the damage. studenti.rs shall in no event be liable for any special, incidental or consequential damages whatsoever (“indirect damages”), including – but not limited to – loss and/or damage of data (including Study Material), loss of profits and lost sales, is excluded.

13.3. studenti.rs’s liability is in any case limited to the highest of the following amounts: (i) the amount actually paid by studenti.rs’s insurance company, or (ii) € 1.000 (thousand euros).

13.4. The limitations and exclusions of liability mentioned in the preceding paragraphs of this article will lapse if and in so far as the damage is the result of intentional or willful recklessness on the part of studenti.rs or its managers (“own actions”).

Article 14. Force Majeure

14.1. In the case of force majeure, the non-fulfillment of the agreement between you and studenti.rs cannot be counted as an attributable failure and studenti.rs is released from all contractual obligations and liability.

14.2. Force majeure includes, but is not limited to, illness of employees and/or absence of personnel crucial for the provision of the Platform, disruptions of the electricity supply, fire, natural disasters, strikes, floods, failures to perform by third parties hired by studenti.rs, disturbances in the internet connection, hardware disruptions, disruptions in the (telecommunications) networks and other unforeseen circumstances.

Article 15. Termination

15.1. You are entitled to discontinue your use of the Platform and to terminate your Profile.

15.2. You accept and acknowledge that any Study Materials posted by you beforehand, will in principle remain accessible via the Platform.

Article 16. Miscellaneous

16.1. These Terms of Use and the use of the Platform are governed by the laws of the State of Delaware, USA, except where mandatory consumer law provides otherwise.

16.2. Any dispute arising out of or relating to these Terms or the Platform shall be brought exclusively in the state or federal courts located in the State of Delaware, USA, except where mandatory law provides otherwise.

16.3. If at any time any provision of these Terms of Use is or becomes illegal, void or invalid for any reason whatsoever, such invalidity shall not affect the validity of the remainder of the Terms of Use and such invalid provision shall be replaced by another provision which, being valid in all respects, shall have effect as close as possible to that of such replaced one.

16.4. studenti.rs is entitled to assign any rights and obligations that result from these Terms of Use to third parties, in which case it will notify you. In the event that you cannot agree with the assignment, your only remedy is to cease the use of the Platform and delete your Profile.
