Introduction

Bosnia and Herzegovina consists of two entities within the state, the Federation of Bosnia and Herzegovina (the federation) and the Republic of Srpska, and Brčko District, with an estimated population of four million. The federation has a Bosniak (Bosnian Muslim) and Croat majority, while the Republic of Srpska has a Serb majority.

This kind of separation has been caused by the recent civil war, which has left the country severly weakend, economicaly and politicaly. Foreign countries rushed to aid us in establishing the constitution  with which we could start our recovery. This constitution is incorporated in The General Framework Agreement for Peace in Bosnia and Herzegovina, initialed in Dayton on 21 November 1995 and signed in Paris on 14 December 1995. One of the most important aspects of this constitution is to protect and preserve basic civil rights and freedoms, and that is why it directly applies the rights and freedoms  set in the European Convention for the Protection of Human Rights and Fundamental Freedoms and its Protocols (European Convention). This paper is about these civil rights and freedoms, their normative and practical aspects and whether the laws that are brought to uphold them are in accordance with the European Convention.
